Bryon McDonald found guilty after trial

A jury has found Bryon McDonald guilty of Attempt to Commit Sexual Assault, a class 5 felony, and Unlawful Sexual Contact, a class 1 misdemeanor for an incident that took place in October of 2021.

In 2021, Bryon McDonald met up with a woman at a bar in Greeley, Colorado. The two had previously dated but were no longer in an active relationship. After McDonald was intoxicated that night, the victim allowed him to return to her residence rather than drive home under the influence. The victim communicated to the defendant that she did not want to engage in any sexual activity. However, the defendant pulled her into a bed and subjected her to unwanted sexual advances and forcible contact.

The victim texted 911 for help while the defendant was still in her residence. Members of the Boulder County Sheriff’s Office responded immediately to help ensure the woman’s safety, placed the defendant into custody and thoroughly investigated the incident. The District Attorney’s Office then filed charges against the defendant.

“This outcome is truly a testament to the strength and resilience of the victim/survivor," said Deputy District Attorney Nick Trevino. "Her actions that night and her resolve to see the case through took a great deal of courage and we are thankful to her. We want to acknowledge the incredible investigative work of the Boulder County Sheriff’s Office and thank the jury for their time and service over the course of the trial.

The charges are probation eligible under the law, but the defendant faces possible penalties of one to three years in the Department of Corrections on the Attempt to Commit Sexual Assault and up to 364 days jail on the Unlawful Sexual Contact. McDonald will be required to register as a sex offender. Sentencing is set for October 6, 2023.

“The Sheriff’s Office moved quickly to help this victim and their investigation led to these guilty verdicts," District Attorney Michael Dougherty said. "Our dedicated Sex Crimes Unit fought for the just outcome. We appreciate the service of the jurors. Most of all, this defendant will now be held accountable because of the victim’s courage that night and all throughout this process.”
